Affidavit of Single Status

An Affidavit of Single Status is a document that may be used by any person (called the "affiant") who wants to prove that he is single and unwed at the time he made the statements in the affidavit. This can be used for any of the following purposes:

• Marriage license. To secure a marriage license, an affidavit of single status may be required by the local civil registrar.
• Marriage abroad. To prove single status and non-marriage of the affiant if has an upcoming marriage with a non-Filipino citizen and will marry outside of the Philippines,
• Acquisition or disposition of a property. If the affiant will buy, acquire, sell, donate, or otherwise dispose of a property, an affidavit of single status may be required. This is because, if the affiant is married, he should obtain the consent of his or her spouse to proceed with the transaction. If he is single, then this affidavit may be used to proceed with the transaction.
• Employment abroad. There are certain situations where the employer may require the prospective employee to execute an affidavit of single status as a prerequisite for employment abroad.

This is not an exhaustive list, and the purpose may depend on the particular circumstance that the affiant is in. This document may also be required by various government agencies and private companies in certain transactions and may be used for any other purpose.

How to use this document

An Affidavit of Single Status contains the following information:

• The identity of the affiant who is proving and stating that he is currently single,
• The status of affiant whether single, separated, or widowed,
• The children of the affiant if any,
• The purpose of writing or executing this affidavit.

The necessary attachments to this affidavit may vary as follows:

• For separated persons. In case the affiant is separated whether by reason of annulment or declaration of nullity of marriage with a previous spouse, then the proof showing such separation should be attached. An example of this is a decree of annulment of marriage.
• For widowed persons. In case the affiant's marriage is dissolved by reason of the death of his or her previous spouse, then a copy of the death certificate of the deceased spouse should be attached.

After completing the affidavit, at least two copies must be printed. Then both copies must be presented and signed in front of a notary public for notarization. One copy will be given to the notary public, and the other will be kept by the affiant and may be used for its intended purpose.

Applicable Law

Affidavits are governed by the 2004 Rules on Notarial Practice. It should also be noted that making untruthful statements in a notarized affidavit may be punishable under the Revised Penal Code of the Philippines.
